application and non-refundable deposit check in the amount of $157.50 (includes
applicable taxes) must be in the hands of the Lessor of Docks no later than January
1 to be considered a
valid application for the beginning of the new year’s harbor occupancy period
and to maintain preferred tenure privileges to the same slip.
A valid Certificate of Liability Insurance in the amount of not less than $300,000.00 MUST BE attached with this application or a valid Certificate in that amount must be on file with the Lessor of Docks otherwise this application is deemed invalid.
It is recommended
that each member review the By-Laws concerning the rental of slips and
moorings. Copies are available at the
club. At the beginning of each year
available slips will be determined by the applications received by January
1 and will be posted at
the Harbor Display in the clubhouse for no less than two weeks. During this time a member may request a slip
change in writing. Following the
two-week period, the Lessor of Docks will make assignments and recommend them
to the Board of Directors for their approval at their next monthly
meeting. All assignments will be
finalized at that meeting and those members approved shall become slip tenants
in the AYC harbor and responsible for all monies and considerations required of
them in the By-Laws and this contract.

I. GENERAL RULES
A.
The
word “Tenant” is used herein to indicate the owner of any boat moored in the
AYC harbor.
B.
The
Tenant agrees to have on file with the Lessor of Docks a valid Certificate of
Liability Insurance of no less than 300,000.00 liability as determined by the
Board of Directors. It will be the
tenant’s responsibility to provide the Lessor of Docks with a valid certificate
within 30 days of the date of expiration.
Failure to comply will result in suspension of slip privileges for the
next season.
C.
No
modifications or alterations are to be made to any slip or dock without prior
approval of the Board of Directors.
D.
Swimming
or fishing is not allowed in the harbor area.
E.
There
is no grilling allowed on the docks or in boats. Fires are allowed in designated picnic areas.
F.
Children
are not allowed on the docks unless accompanied by and adult.
G.
Pets
shall be leashed when on Yacht Club property.

The
gas dock is to be used only for obtaining gas, head pump out, loading and
unloading. Fueling at slips is
prohibited.
I.
The Tenant is responsible for the upkeep to
his slip, painting, cleaning (spiders & bird droppings), nailing loose
boards, reporting at once any major repairs needed. Tenant’s failure to maintain his / her slip
may result in AYC hiring the work done after two (2) weeks notification. Any expenses involved will become the responsibility
of the Tenant.
J.
No one is allowed to climb the fence. If your key is forgotten, ask another to let
you in.
II. VESSEL CONDITION & MAINTENANCE
A. To be
admitted and to continue as a Tenant of the

Registered, identified, marked, equipped and
maintained as required by law and safe practice.
2.
Inspected annually by the Coast Guard
Auxiliary by June 15 as set by the Board of Directors. All requirements of the Coast Guard Auxiliary
Vessel Safety Examiner’s VSC must be met to qualify for summer and / or winter
privileges.
3.
Subject to periodic inspection by the AYC
Safety Committee to determine the maintenance of proper safety conditions as
required by the Coast Guard and any other lawful authority.
B.
While at the AYC, all vessels must be
maintained in a neat, attractive and seaworthy condition. Failure to maintain your vessel will result
in a five (5) day notice to correct all adverse conditions. Failure to comply will result in a fourteen
(14) day termination notice.
III. SLIP RENTAL
A.
Seasonal
rental periods shall be defined as summer (May 1 – October 31) and winter
(November 1 – April 30).
B.
The
slips and docks at the AYC are under the control of the Board of
Directors. They shall assign and
allocate slips as spelled out in the AYC By-Laws.
C.
Tenant shall make every effort to notify the
Yacht Club when their slip will be vacant overnight or for extended
periods. The AYC reserves the right to
rent Tenant’s slip during periods of Tenant’s absence. Such use will be without payment to the
Tenant.
D.
Tenant may not sublet or otherwise permit
anyone else to use the Tenant’s slip.
Only one vessel may be registered to a specific slip on a seasonal
basis. If a Tenant sells his/her vessel
and purchases a different vessel, the Tenant may continue to lease the slip,
provided the new vessel meets all other applicable requirements.

Tenant shall not allow anyone to operate
his/her vessel within the

The Board of Directors is authorized and
empowered at their sole discretion and judgment to determine and cancel any
slip privilege at any time as prescribed in the AYC By-Laws. Slip privileges will be suspended for the
following season for failure to pass Coast Guard Auxiliary inspection or lack
of a valid Certificate of Liability Insurance as mentioned in Sections I and
II.
IV. CONDUCT
A.
Movement of boats within the harbor must be
on a “no wake” basis.
B.
Tenant shall conduct him or herself so as
not to unreasonably annoy, bother, or interfere with the rights and privileges
of the other Tenants. Tenant is
responsible for the conduct of guests.
C.
While
at the Appleton Yacht Club, the Tenant, his agents, or invites, agree to abide
by all regulations of the
V. STORAGE
A.
No boat may remain in dry storage past the
June 15 Coast Guard Inspection deadline without the express permission of the
Board of Directors.
B.
Beams may be stored in the designated area
or your slip provided it is done in a manner that is acceptable to the Tenant
on either side and the Safety Committee. Beams must be stored the same day the boat is
put in the water. All beams stored at
the club must be marked with the Tenant’s name.
C.
Absolutely no cradles, blocking, or lumber
is to be stored on Club property.
VI. EQUIPMENT
A.
Work
Slip:
1.
The work slip will not be leased during the
boating season and must be kept open for emergency use.
2.
Slip rental will include the use of the Work
Slip, slings and jacks two (2) times per year.
Additional use is $5.00 for members, $20.00 per day for
non-members. All fees must be paid in
advance.
B.
Jacks,
Slings, Work Rafts, Choker Cables, and any other tack can be (and should
be) reserved in advance by signing up in the calendar for such purpose
in the clubhouse. Although not a
requirement, it prevents conflicts with other members’ interested in using the
same equipment at the same time on the same day. For emergencies exceptions will always be
made; otherwise however, those who have signed up have priority.
C.
Work Rafts, when not being used must be
returned and secured at all times in their storage area ONLY. You are responsible for any damage or loss to
the rafts. Never leave a raft under a
boat or dock overnight (changing water
levels can cause serious damage to it and can make the work raft useless for
days or weeks while pinned under a dock, beam or boat).
D.
Tack
Room:
1.
The Tack Room is for Club Equipment
Only. NO PERSONAL ITEMS MAY BE KEPT
THERE.
2.
Items stored behind the restricted “gated
area” are either owned or loaned to the Appleton Yacht Club and are being used
by either the Harbor Committee or the Slips and Docks Committee or both. THE GATED AREA WITHIN THE TACK ROOM IS
RESTRICTED AND OFF LIMITS TO MEMBERS.
3.
Members’ gate door keys open the door to the
tack room; therefore, members are responsible to insure that the Tack Room door
is kept locked at all times.
4.
All equipment is to be returned to the
location it is stored.. No equipment
is to leave the club premises without prior approval of the Board of Directors.
5.
The Slips and Docks Committee shall assess a
$20.00 charge to a Tenant for failure to return equipment properly and promptly
to the Tack Room.
